Sonntag & Partner advises Construcciones y Auxiliar de Ferrocarriles (CAF) S.A. on their way to win a potential € 2 billion Frame Work Supply Agreement with Deutsche Bahn
Construcciones y Auxiliar de Ferrocarriles (CAF) S.A., a listed Spanish company and one of the international market leaders in the design, manufacture, maintenance and supply of equipment and components for railway systems, has been awarded, together with two other international competitors, a framework supply agreement with Deutsche Bahn regarding the tentative supply of up to 400 electric trains for regional and commuter transport.
The total contract volume will amount to up to two billion Euros whereby the supplies will be made until the end of 2018. The supply contracts will be awarded subsequently in separate tenders and be based on the framework supply agreement as well as on the specifications set for the respective single calls for tender.
Under the lead of Frank Behrenz, Partner and Head of the Munich based Spanish Desk of Sonntag & Partner, CAF was advised on the legal aspects of the tender as well during the negotiations and the conclusion of the framework supply agreement by Dr. Rudolf Rupprecht (Counsel, distribution & commercial law) and Johanna Leisch (Senior Associate, corporate & commercial law).
