Food & Health Law

Food law and health law are a kind of cross-section having common grounds with many other fields of law. Therefore, interdisciplinary and special legal knowledge is indispensable. Even the differentiation between food, drugs and medical devices pose questions as there are different liability consequences for our clients. The German and in particular the European legislation on food law and health law is changing constantly (keyword: health claims directive) so that it is of essential importance for the marketability of the products to know the current legislation and to apply it correctly.

We assist you in the conception of advertising measures in the different advertising media, advise you on product labelling and represent you in legal proceedings against competitors or before any competent authorities in other conflict situations. Our multidisciplinary orientation enables us to provide our clients with additional advice in the fields of law bordering on food law and health law, for example in the context of the protection of property rights (brands, registered designs, and patents), distribution law and product liability.

Our activities in the field of food law and health law focus on:

• advice on product advertising and product labelling under consideration of food law and competition law
• advice on the introduction and development of new products, in particular in the area of application of the health claims directive
• legal representation in the context of the enforcement and defence of claims relating to competition law as well as other forms of conflict resolution
